This Privacy Policy describes how HurtCallMax (“we,” “us,” “our”) collects, uses, discloses, and protects personal information when you visit hurtcallmax.com or use our services. We are committed to protecting your privacy and complying with the Personal Information Protection Act of Alberta (“PIPA”) and the federal Personal Information Protection and Electronic Documents Act (“PIPEDA”).
HurtCallMax is a personal-injury referral service based in Edmonton, Alberta. We are not a law firm and do not provide legal services. We connect injured Albertans with independent personal-injury law firms in our network.
1. Information we collect
1.1 Information you provide directly
When you submit our case-review form, call our intake line, or otherwise contact us, you may provide your name, your phone number, your email address, information about your accident or injury (including date, location, and nature of injury), and any other information you choose to share.
1.2 Information collected automatically
When you visit hurtcallmax.com, our servers and our service providers may automatically collect your IP address; your browser type and version, operating system, and device type; the pages you visit on our site, the time and duration of your visit, and the pages you came from and went to; and cookies and similar tracking technologies (see Section 6).
1.3 Information we do not collect
We do not knowingly collect information from individuals under the age of 18. We do not collect government-issued identification numbers, Social Insurance Numbers, payment-card information, banking information, or any sensitive financial information through this website. If you believe a minor has provided personal information to us, please contact us using the details in Section 11 and we will delete it promptly.
2. How we use your information
We use the personal information you provide to connect you with one or more independent personal-injury law firms in our referral network for the purpose of evaluating your potential legal claim; respond to your inquiries; send you information you have requested; improve our services and website performance; comply with legal obligations; and detect, prevent, and address fraud, security issues, and technical problems.
We will not use your personal information for any purpose that is not described in this Privacy Policy without first obtaining your consent.
3. How we share your information
3.1 With independent law firms in our referral network
The primary purpose for collecting your contact information through the case-review form is to share it with one or more independent personal-injury law firms in our referral network. By submitting the form, you are providing express consent for us to share your name, contact information, and the details of your potential claim with one or more participating law firms so they may contact you to discuss representation. You may withdraw this consent at any time by contacting us before a referral is made.
We are paid a referral fee by participating law firms. This referral fee does not increase the legal fees you pay if you retain one of these firms. Each participating firm is independently owned and operated; HurtCallMax does not control their legal services or fee arrangements.
3.2 With service providers
We share information with third-party service providers who help us operate the website and our services, including hosting providers, content delivery network and security providers, email and communication providers, analytics providers, and anti-spam services. These providers are contractually obligated to handle personal information consistent with this Privacy Policy and applicable law. Some of these providers may store or process information in the United States or elsewhere outside Canada (see Section 7).
3.3 For legal reasons
We may disclose your information when we believe disclosure is required by law, regulation, court order, or government request, or to protect our rights, property, safety, or that of others.
3.4 In a business transfer
If HurtCallMax is acquired by, merges with, or sells assets to another entity, your information may be transferred to that entity. We will provide notice on this website if such a transfer affects your information.
3.5 We do not sell your personal information
We do not sell, rent, or trade your personal information to third parties for marketing purposes that are unrelated to our core service.
4. How long we keep your information
We retain personal information only as long as necessary for the purposes described in this Privacy Policy, or as required by law. Form submissions and intake records are retained for 24 months and then securely deleted, except where a law firm in our network has accepted your case (in which case the firm becomes responsible for retention under its own policies). Website analytics data is retained for 14 months. Email correspondence is retained for 24 months and then securely deleted. You may request earlier deletion of your information at any time (see Section 5).
5. Your rights
Under PIPA and PIPEDA, you have the right to access the personal information we hold about you; correct inaccurate or incomplete information; withdraw consent for our use or disclosure of your information at any time, subject to legal or contractual restrictions and reasonable notice; request deletion of your personal information, subject to our legal obligations; and make a complaint about our handling of your personal information to our Privacy Officer (Section 11) or to the Office of the Information and Privacy Commissioner of Alberta or the Office of the Privacy Commissioner of Canada.
To exercise any of these rights, contact us using the details in Section 11. We will respond within 30 days, as required by PIPA.
6. Cookies and tracking technologies
Our website uses cookies and similar technologies. Cookies are small data files stored on your device. We use them to maintain your session as you navigate the site, remember your preferences, measure how visitors use the site (analytics), and detect and prevent spam and abuse. You can control cookies through your browser settings; most browsers allow you to refuse cookies or alert you when cookies are being sent. Disabling cookies may limit some functionality. We do not use cookies for cross-site behavioral advertising on this website.
7. Cross-border transfers
Some of our service providers (including our hosting provider) operate servers in the United States. By using our website, you understand that your personal information may be transferred to, stored in, and processed in the United States, and that information stored outside Canada may be subject to the laws of the foreign jurisdiction. We require all service providers to maintain protections substantially comparable to those required under Canadian privacy law.
8. Security
We use reasonable physical, technical, and administrative safeguards to protect personal information from unauthorized access, use, disclosure, alteration, or destruction. These safeguards include encrypted transmission (HTTPS), restricted access to systems holding personal information, and industry-standard hosting security. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Children’s privacy
This website is not directed at children under the age of 18, and we do not knowingly collect personal information from children. If you are under 18, please do not submit any personal information through this site. If you believe a minor has submitted personal information, please contact us (Section 11) and we will delete it promptly.
10. Changes to this policy
We may update this Privacy Policy from time to time. The “Last updated” date at the top of this policy reflects the most recent version. Material changes will be communicated by a prominent notice on the website. Your continued use of the website after changes are posted constitutes acceptance of the revised policy.
