Questions to ask a personal-injury lawyer in Alberta

A first conversation should help you understand whether the lawyer can assist and what hiring them would involve. You do not need a perfect file to start asking clear questions.

Before the conversation

  • Prepare a brief incident timeline, relevant insurer letters and any deadline you know about.
  • Write down what you want help with: benefits, liability, an offer, a missed-work issue or uncertainty about your options.
  • Do not email a full medical file before the firm explains its secure intake process.

Ask about responsibility and fit

  • Are you currently able to consider this type of matter?
  • Who would be responsible for my file and who would contact me day to day?
  • What similar issues have you handled, and what information is still needed before you can assess mine?
  • Does the firm need a conflict check or information about another party before deciding?

Ask about money in writing

  • How is the legal fee calculated and when is it payable?
  • What taxes, disbursements, interest or other costs could apply?
  • Who funds reports and other expenses while the matter is open?
  • What could I owe if there is no recovery, I end the engagement or I change firms?
  • Can you show how a hypothetical gross settlement would become a net payment under the agreement?

Ask about deadlines and communication

  • Which limitation, notice and insurance deadlines have you checked?
  • Has the firm accepted responsibility for taking any urgent step?
  • How will I receive updates and how should I send a new letter or offer?
  • Can the firm accommodate my language, mobility, support-person or scheduling needs?

Before you sign

Read the proposed agreement and ask about any term you do not understand. Confirm the scope of work and who makes settlement decisions. Verify the lawyer through the Law Society of Alberta directory. A free HCM introduction does not oblige you to retain that firm.
